Lawsuits and manifesting outcomes

Ive been involved in an ongoing lawsuit since 2023 from a former franchise i was a part of. They did a lot of underhanded and fraudulent things to get me and others to buy franchises and obtained waivers once another franchise sued and them and won. I never really got a fair chance in arbitration to present my case and was pro se. I had already sunk my life savings into it and was broke to fight any litigation. I had racked up a bunch of debt in the process of trying to keep the franchise afloat. Eventually I resided to walking away and eventually filing bankruptcy. They came and created problems in my bk that has held my bankruptcy up for several months. Because they did this it potentially opened the doors that were almost surely closed for a future litigation in California where that previously wouldn't have been an option without the contiued pursuit of me in bk.. I had back in the arbitration days created a scene of winning. But I don't know if it took or assumptions overided. When they showed up to my bk creditor meeting I felt like someone punched me in the stomach. But later realized they could have opened a door that might not otherwise been open. It was still a bit of a long shot. My house went into foreclosure and still is right now. There is a program with the va to catchup my arrears for 0% and no payments due till I pay off my va loan. Perfect solution to my problem but I had to have mt bk discharged to be eligible. Recently had a newborn and I have felt like I am in quicksand to move on with my life while trying to find money to now fight the case they filed that is holdingy bk from going through. It holds all the other debt with it and my house hangs in the balance too. I have 1.1 million in debt the bankruptcy would wipe clean and start over and keep my house. The debt I owed to them from the judgement was about 400k. I needed to win in the bk court which would take another 50 or 60k to get to trial. Would not be able to recover those fees even with a win. And no guarantee a win would not have an appeal. These guys do 20 million a year in royalty revenue and have deep pockets to keep a fight alive for years. I had made a few imaginal acts months ago where I had told s friend I finally won in California and the award was substantially larger not just for the fraud but puntives and other as a result of what they did by following me into my bk. There were several other factors involved i dont need to get into. But I really felt the pursuit in my bk might be a gift. But it was also a huge gamble and difficult to make money. Or move on with my life and not be consumed with the case.. Today we did mediation and right up till today it was going to be a hard no just doing mediation cause the judge ordered it. It was all day long back and forth. We started at 400k and I started at 10k to go away. I thought for sure I or they woild take a hard stance we couldn't come to terms on. By the end of the day we negotiated 40k over a year timeline and then another 27k in payments over 5 years. So 67k. That basically wipes out their 400k and another 700k of other debt since this entire proceedings is jeopardizing the other debts to be wipe out. It also ends tbe torment for me and my family. Allows me to move forward with saving my house from foreclosure too. All in all 67k for 1.1 mill in debt. I havent made.house payment on the house almost 1 year. So we had a break during having a newborn that meant my wife took months off of work. That money at the back of my 26 years left mortgage wont impact us since it is 0% and no payments due. There were way too many plates to keep spinning for years to come. Not just the 6 months to a year it would take to get trial on the bk. House in foreclosure now i dont know i could of.stalled that long enough to get trial done and win and bk discharged. Even then after everything I would need to stack 100 to 250k for an atty to take my case in California and still would be sharing 20% of the win if we won it all. Not to mention potentially the trustee in the bk could claw back any award I won later and distribute to my creditors. I feel like I did tbe right thing in the end. It was a more than fair tradeoff in terms of what I wiped.out to zero by doing the deal.. the deal did kill any chance for both of us to come after the other in any court. So there is peace of mind that also makes the cost worth no longer having the stress.. I feel like although I have closed the door on a windfall of potential money if I won it all. I have also opened myself to receive this money in exchange through a countless number of ways vs it has to be through litigating this case. This was long but appreciate any insight and thoughts on this.
